1. Acceptance of Terms

By accessing or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy, which is incorporated here by reference. If you are using the Service on behalf of someone else, you represent that you are authorized to accept these Terms on their behalf. We may update these Terms from time to time as described in Section 18.

2. About the Service

RTVSIM is a browser-based collection of reality-TV strategy simulators. You cast a set of contestants and the simulator plays out a season — alliances, votes, twists, and eliminations — for your entertainment. The Service is a work of original fiction.

The Service is provided on an "as is" and "as available" basis without warranties of any kind. We may add, change, suspend, or discontinue any part of the Service at any time. Any contributions you make toward the Service (including memberships) help cover hosting, development, and improvements, and do not entitle you to any specific feature, outcome, or continued availability.

3. Eligibility & Age

You must be at least 13 years of age to create an account or use the Service, and you must meet the minimum age of digital consent in your own country or jurisdiction, which may be higher. Users under 13 are strictly prohibited from creating an account.

If you live outside the United States, you are responsible for reviewing your local laws before signing up to confirm you meet your jurisdiction's minimum age requirement. In the European Union, the minimum age of digital consent is generally 16 (some member states set it as low as 13), so EU users should treat 16 as the default minimum unless their member state allows younger. The United Kingdom generally sets this age at 13.

If we learn that we have collected personal information from a user below the applicable minimum age, we will delete that information and terminate the account as soon as reasonably possible. If you believe a minor has provided us personal information, contact privacy@rtvsim.com.

4. Accounts

You may create an account to save your progress and sync across devices. You are responsible for maintaining the confidentiality and security of your account credentials and for all activity that occurs under your account. You agree to provide accurate information when creating an account and to keep it up to date. Notify us promptly at legal@rtvsim.com of any unauthorized use of your account.

5. Pro Memberships & Billing

Parts of the Service are offered as a paid membership ("RTVSIM Pro"). Prices, plans, and included features are described on the Service and may change over time. By purchasing a membership you authorize us and our payment processors to charge the applicable fees and any taxes to your chosen payment method.

Recurring plans

Monthly and annual memberships automatically renew at the end of each billing period at the then-current price until you cancel. You may cancel at any time from your account settings; cancellation takes effect at the end of the current paid period, and you retain access until then.

Lifetime plans

A "Lifetime" membership is a one-time payment with no recurring charge. "Lifetime" means for the operational lifetime of the RTVSIM Service; it is not a guarantee that the Service, any individual game, or any specific feature will be offered indefinitely.

Refunds

Except where a refund is required by applicable law, all payments are non-refundable and there are no refunds or credits for partially used periods, unused features, or downgrades. Where local law grants you a statutory cancellation or withdrawal right, that right is unaffected by this section.

6. Your Content & Uploaded Images

Some features let you provide content — including images you upload or link by URL for use as contestant avatars ("Your Content"). You retain ownership of Your Content. By providing Your Content, you grant the Company a non-exclusive, royalty-free, worldwide license to host, store, reproduce, and display that content solely for the purpose of operating and providing the Service to you.

Your warranties

You represent and warrant that:

• You own or have all rights, licenses, consents, and permissions necessary to provide Your Content and to grant the license above;
• Your Content does not infringe or violate any third party's rights, including copyright, trademark, privacy, publicity, or other rights;
• If Your Content depicts any identifiable person, you are that person or you have that person's express permission to upload and display their likeness; and
• Your Content does not violate Section 7 or any applicable law.

You are solely responsible for Your Content and for any consequences of providing it. The Company does not pre-screen all user content. For content provided by URL, we act as a passive conduit for the distribution of user-provided links and are not responsible for the content located at those URLs. We do not endorse, and are not responsible or liable for, any user content; you access user content at your own risk.

7. Prohibited Content

You agree not to upload, link, post, or otherwise provide any content that is, contains, depicts, or promotes:

• Pornographic, sexually explicit, or nude material, or any sexualized depiction of a minor (which is strictly forbidden and will be reported to authorities);
• Graphic violence, gore, mutilation, or horror intended to shock or disturb;
• Harassment, bullying, stalking, or threats directed at any person;
• Hateful or discriminatory content targeting people based on race, ethnicity, national origin, religion, sex, gender, sexual orientation, disability, or other protected characteristic;
• Defamatory, libelous, or knowingly false statements about a real person;
• Material that is illegal or that promotes or facilitates illegal activity;
• Content depicting an identifiable real person without their consent, or that violates anyone's privacy or publicity rights;
• Content that infringes any copyright, trademark, or other intellectual-property right; or
• Malware, spam, or content designed to disrupt or exploit the Service.

Do not use questionable material to test our content policies or to gauge what we will allow. If you have to ask whether something is appropriate, do not upload it.

8. Prohibited Conduct

You agree not to: attempt to gain unauthorized access to the Service, its accounts, or its systems; use the Service for any unlawful purpose; interfere with or disrupt other users' enjoyment of the Service; exploit bugs or vulnerabilities for unintended purposes; scrape, reverse-engineer, or copy the Service except as permitted by law; or impersonate any person or misrepresent your affiliation with any person or entity.

9. Moderation, Removal & Bans

We may, in our sole discretion and without prior notice, review, refuse, remove, or disable access to any content that we believe violates these Terms or is otherwise objectionable. We are not obligated to monitor content but may do so.

If you violate these Terms, you may temporarily or permanently lose the ability to create or save content and may lose access to your account and the Service. We maintain a repeat-infringer policy: users who repeatedly violate these Terms or others' intellectual-property rights may be permanently banned. To report a violation, contact legal@rtvsim.com.

10. Copyright & DMCA

We respect intellectual-property rights and respond to valid notices under the U.S. Digital Millennium Copyright Act (DMCA) and equivalent laws. If you believe content on the Service infringes your copyright, send a written notice to our designated agent at dmca@rtvsim.com that includes:

1. Your physical or electronic signature;
2. Identification of the copyrighted work you claim has been infringed;
3. Identification of the infringing material and information reasonably sufficient to let us locate it (e.g., the in-game location or image URL);
4. Your contact information (address, telephone number, and email);
5. A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law; and
6. A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf.

We will respond to valid notices and remove infringing material as soon as reasonably possible, and we will terminate the accounts of repeat infringers in appropriate circumstances. Submitting a knowingly false notice may expose you to liability.

11. Our Intellectual Property

All game code, design, generated artwork, names, logos, and original content of the Service are the property of the Company or its licensors and are protected by intellectual-property laws. Except for Your Content, you may not copy, modify, distribute, sell, lease, or reverse-engineer any part of the Service without our prior written permission.

12. Non-Affiliation & Trademarks

RTVSIM, betrayal island, eviction house, chaos castle, and world race are original works created for entertainment purposes only. They are not affiliated with, endorsed by, sponsored by, licensed by, or associated with any television network, production company, streaming service, or reality-television show or franchise.

Any resemblance between our simulators and existing media properties is for the purpose of genre simulation only. All third-party trademarks, service marks, and trade names are the property of their respective owners; any reference to them, if made at all, is descriptive and does not imply any endorsement, sponsorship, or affiliation. We do not use, and do not permit users to use the Service to impersonate, the logos, taglines, artwork, or other protected branding of any real program or network.

13. Disclaimers

THE SERVICE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, secure, or error-free, that defects will be corrected, or that any content (including user content) is accurate, lawful, or non-infringing. Some jurisdictions do not allow the exclusion of certain warranties, so some of these exclusions may not apply to you.

14. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, THE COMPANY AND ITS OWNERS, OPERATORS, AND CONTRIBUTORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, GOODWILL, OR INTERRUPTION OF SERVICE, ARISING FROM OR RELATING TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE OR ANY USER CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY.

IN NO EVENT SHALL THE COMPANY'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US, IF ANY, FOR THE SERVICE DURING THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) USD $50. Some jurisdictions do not allow certain limitations of liability, so some of these limitations may not apply to you.

15. Indemnification

You agree to defend, indemnify, and hold harmless the Company and its owners, operators, and contributors from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or relating to: (a) Your Content; (b) your use of the Service; (c) your violation of these Terms; or (d) your violation of any law or of any third party's rights, including any claim that Your Content infringed or misappropriated another's intellectual-property, privacy, or publicity rights. We reserve the right to assume the exclusive defense of any matter subject to indemnification, in which case you agree to cooperate with us.

16. External Links & Third-Party Content

The Service may display content from external websites through user-provided image URLs, and may link to third-party sites or services. We do not control and are not responsible for the content, privacy practices, or availability of any external website or service. Linking to or displaying external content does not imply endorsement of that site or its content. Your dealings with third parties are solely between you and them.

17. Privacy

Our handling of personal information is described in our Privacy Policy. By using the Service, you acknowledge that information will be processed as described there. We do not sell your personal information.

18. Changes to These Terms

We may modify these Terms at any time. When we do, we will revise the "Last updated" date above and, where appropriate, provide additional notice. Changes are effective when posted. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms. If you do not agree to the changes, stop using the Service.

19. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, for violation of these Terms or for any other reason at our discretion. Multiple infractions may lead to a permanent ban. Upon termination, your right to use the Service immediately ceases, and we may delete your account and associated data. Sections that by their nature should survive termination — including ownership, disclaimers, limitation of liability, indemnification, and governing law — will survive.

20. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Georgia, United States, without regard to its conflict-of-law provisions.

To the fullest extent permitted by law, any dispute arising from or relating to these Terms or the Service shall be resolved through binding arbitration administered under the rules of the American Arbitration Association, rather than in court, and you waive any right to a jury trial and to participate in a class action against the Company. Nothing in this section prevents either party from seeking injunctive relief in a court of competent jurisdiction for intellectual-property or unauthorized-access claims. If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect. Nothing here limits rights you may have under the mandatory consumer-protection laws of your country of residence.
